Terms of Service – NextGen SEO & GEO
This document defines the Terms of Service for NextGen SEO & GEO (the "System"), operated by Avitan Shai, exempt dealer (osek patur) no. 035728203, address: Yona Wallach 14 Apt. 30, Hod HaSharon 4504134, Israel. Use of the System constitutes full agreement to these terms.
1. Definitions
"The System" – a SaaS platform for digital marketing. "The Client" – any person or entity using the System. "The Operator" – Avitan Shai, exempt dealer (osek patur) no. 035728203, address: Yona Wallach 14 Apt. 30, Hod HaSharon 4504134, Israel.
2. Scope of Service
The System enables creating marketing content, publishing to social networks, website and SEO improvement, data analysis and reporting.
3. Use of TikTok Interfaces
The System uses TikTok Login Kit and the Content Posting API to publish content to your TikTok account, and only after you have explicitly authorised it. The scopes we request are user.info.basic (your account display name and picture, so you can see which account you are publishing to) and video.publish (direct posting of content you approve). Every post is published only after you have selected the privacy setting and the interaction settings yourself on the publishing screen. Connecting a TikTok account is optional, and you can disconnect it at any time from the platform settings in the System or from the security settings of your TikTok account.
4. Client Responsibility for Content
The client is solely responsible for all content created or published through the System and for its compliance with law.
5. Connecting to External Platforms
The client connects third-party accounts (Facebook, Instagram, TikTok, LinkedIn, Google, WhatsApp) via OAuth. The System is not responsible for third-party malfunctions.
6. Automatic Website Changes
The System may update content and tags on the client's website, per predefined safety rules and a whitelist, with the client's consent.
7. Commitment to Proper Use
The client agrees not to use the System to create content that violates the law. The Operator may block access upon violation, without refund.
8. Limitation of Liability
The System is provided As-Is. The Operator's liability, if any, is limited to the amount paid in the most recent period.
9. Intellectual Property
All intellectual property rights belong to the Operator. The client receives a limited, non-exclusive license to use the service.
10. Changes to Terms
The Operator may update these terms from time to time; continued use constitutes agreement.
11. Governing Law and Jurisdiction
Subject to Israeli law; jurisdiction lies with the courts of the Central/Tel Aviv district.
